After hearing a petition seeking for quashing the extortion case filed against
BNP Sr Joint Secretary General Tarique zia, the High Court Monday set today
(Tuesday) for an order, .Moving the petition before a division bench,
his counsel advocate TH Khan submitted that the extortion case filed
gainst his client under the Speedy Trial Tribunal Act was “not maintainable”,
as the police submitted chargesheet after the 60-day stipulated time under
section 19 of the Act.
Citing provision of the tough law, he said,
“Trial of an alleged extortionist cannot take place if not caught red-handed during the crime.”
He contended that Tarique was arrested on March 7 and sued in the extortion
case filed with Gulshan police station the following day by Amin Ahmed,
the owner of a construction firm, charging him with extortion of Tk 1 crore on
December 30 last year. According to the FIR, Tarique received the money through
his personal staff on January 4, this year.
Opposing his contentions, state attorney Abdur Rouf submitted that
the extortion case was not filed under the Speedy Trial Tribunal Act—it was
lodged under the Emergency Powers Rules(EPR) 2007.
Referring to the April 8 amendment to the EPR,
he told the court that the extortion case filed against Tarique was
“ valid as the amendment has given retrospective effect”
